SETH, Circuit Judge After examining the briefs and appellate record, this panel has determined unanimously that oral argument would not materially assist the determination of this appeal. See Fed. R. App. P. 34(a); Tenth Cir. R. 34.1.9. The cause is therefore ordered submitted without oral argument. Appellant Cesar Fuentes-Galindo was charged and convicted of four felony counts of illegally transporting aliens in violation of 8 U.S.C. § 1324(a)(1)(B). He contends that three of those counts should be reversed because the trial court erred in admitting depositions into evidence. Both the United States and appellant assert that the requirements of Fed. R. Crim. P. 15(a) were not satisfied; therefore, Counts I, III, and IV of his conviction must be reversed. We agree and reverse his conviction as to the above-referenced counts.
